| TENDER DESCRIPTION | 17 LIQUIDATED DAMAGES (LD): 17.1 Buyer reserves the right to recover from the Supplier, as agreed liquidated damages and not by way of penalty, a sum equivalent to half (½) percent of the total value of undelivered main supply portion excluding GST per week or part thereof, subject to a maximum of ten (10) percent of the total contract value of main supply excluding GST, if the Supplier fails to deliver any part of the ordered goods/stores within the period stipulated in the Order/ Contract. LD shall be applicable project wise. 17.2 For Mandatory Spares: - LD on mandatory spares portion where delivery for mandatory spares is defined separately in the Order/Contract. LD shall be applicable @ ½ percent, of the total value of undelivered mandatory spares portion excluding GST per week or part thereof, limiting to 10% of total contract value of mandatory spares excluding GST. LD shall be applicable project wise. Other terms & Conditions of the ATC shall remain unchanged. |
